All stages of the Special Participation distribution process by the ANP, related to the second quarter of 2024 production, were completed today (August 26).

The total amount of Special Participation from the second quarter of 2024 allocated to municipalities, states, and the federal government was R$ 8.70 billion.

The amount directly transferred to the states was R$ 3.48 billion, while municipalities received R$ 870 million. In terms of the number of beneficiaries, transfers were made to 21 municipalities and four states.

Special Participation Distribution

Special Participation is an extraordinary financial compensation owed by concessionaires of oil or natural gas exploration and production for fields with high production volumes.

The ANP is responsible for calculating and distributing Special Participation to the beneficiaries (Federal Government, States, and Municipalities).

To calculate Special Participation on oil and natural gas production, progressive rates are applied to the net revenue of each field's quarterly production. These rates vary according to the location of the extraction, the number of years of production, and the respective volume of quarterly production, considering allowed deductions (royalties, exploration investments, operational costs, depreciation, and taxes).

The allocation of Special Participation resources follows four types of distributions specified in the legislation:

  1. For resources from onshore fields, 50% are allocated to the Federal Government, 40% to producing states, and 10% to producing municipalities, as determined by Article 50 of Law 9.478/97.

  2. For resources from fields with a declaration of commerciality prior to December 3, 2012, involving pre-salt production and located in the area defined by item IV of Article 2 of Law 12.351/10 (DARF 3037), 50% of these resources are allocated to the Social Fund provided by the same law, 40% to states bordering the continental shelf where production occurs, and 10% to bordering municipalities.

  3. For resources from offshore fields, except pre-salt fields and where commerciality declarations occurred before December 3, 2012, 50% are allocated to the Federal Government, 40% to states bordering the continental shelf where production occurs, and 10% to bordering municipalities, as determined by Article 50 of Law 9.478/97.

  4. For resources from offshore fields with a declaration of commerciality after December 3, 2012 (DARF 3990), 50% are allocated to the Federal Government, 40% to states bordering the continental shelf where production occurs, and 10% to bordering municipalities, as determined by Law 12.858/13.
